Las molestias que este tipo de arrendamiento genera a los vecinos copropietarios que residen en el edificio ha hecho que, desde su inicio, se busquen fórmulas para limitar o prohibir dichos arrendamientos en la propiedad horizontal. El acuerdo de la Junta de los propietarios prohibiendo los arrendamientos turísticos ha generado discusión doctrinal y jurisprudencial, provocando incluso un cambio legislativo que, no obstante, no era de interpretación univoca. La jurisprudencia del TS ha ido señalando cómo deben interpretarse la ley y los acuerdos limitativos en tal sentido. Por eso, en este trabajo, se va a analizar la doctrina jurisprudencial sobre la interpretación que debe hacerse del art. 17.12 LPH, que recoge la posibilidad de limitar, mediante acuerdo de la Junta, dichos arrendamientos. Se va a analizar la posibilidad de limitar o prohibir ex novo y expresamente los arrendamientos turísticos en una comunidad horizontal, teniendo en cuenta la interpretación final que han hecho las recientes sentencias del Tribunal Supremo de 3 octubre 2024, acogiendo la tesis de la posible prohibición acordada por mayoría de 3/5, en vez de la unanimidad requerida para la modificación de estatutos.Tourist rentals in apartments of a building subject to condominium property (horizontal property) have been a continuous source of conflict since their approval as special leases excluded from the scope of the LAU (art. 5.e)). The disturbances that this type of lease generates for co-owner neighbors residing in the building have meant that, since its inception, formulas have been sought to limit or prohibit such leases in condominium property. The agreement of the Owners' Association prohibiting tourist rentals has generated doctrinal and case-law discussion, even triggering a legislative change that was, however, not univocal in its interpretation. Supreme Court case law has been indicating how the law and limiting agreements in this regard should be interpreted. Therefore, in this work, we will analyze the case-law doctrine on the interpretation that should be made of art. 17.12 LPH, which provides for the possibility of limiting such leases by agreement of the Owners' Association. We will analyze the possibility of limiting or prohibiting tourist rentals ex novo and expressly in a condominium community, taking into account the final interpretation made by the recent Supreme Court judgments of 3 October 2024, adopting the thesis of a possible prohibition agreed by a 3/5 majority, instead of the unanimity required for the amendment of bylaws.
