A partir del marco teológico-jurídico de las Relecciones de Vitoria —dominium, ius gentium, ius communicationis, libertad de predicación y tutela de inocentes— se examina cómo estos principios se proyectaron en las Leyes Nuevas de 1542 y en la Recopilación de 1680, configurando un ordenamiento orientado a limitar abusos, reconocer capacidades civiles y garantizar mecanismos de justicia. El estudio integra además la lectura histórico-crítica de Alcalá-Zamora, quien reinterpreta el orden indiano como un sistema normativo pionero en la protección de poblaciones vulnerables y en la humanización del poder. La comparación entre ambos autores permite comprender la continuidad entre el fundamento ético del siglo XVI y la valoración jurídica del siglo XX, así como su relevancia para el derecho internacional contemporáneo.This article analyses the convergence and evolution of Hispanic legal thought through Francisco de Vitoria and Niceto Alcalá-Zamora, taking as its axis the racial question and the protection of indigenous peoples in the Laws of the Indies. Starting from the theological-legal framework of the Relecciones —dominium, ius gentium, ius communicationis, freedom of preaching and tutelage of the innocent— it examines how these principles were projected in the New Laws of 1542 and in the Compilation of 1680, shaping a legal order oriented towards limiting abuses, recognising civil capacities and guaranteeing mechanisms of justice. The study also integrates the historical-critical reading of Alcalá-Zamora, who reinterprets the Indian order as a pioneering normative system in the protection of vulnerable populations and the humanisation of power. The comparison between both authors allows us to understand the continuity between the ethical foundation of the sixteenth century and the legal assessment of the twentieth century, as well as its relevance for contemporary International Law.
