La publicación de la Constitución Española con la definitiva incorporación de la función social de la propiedad como contenido propio de este derecho supuso un cambio defintivo. Sin embargo, estamos observando cómo ese concepto y contenido del derecho de propiedad aceptado con la CE sigue evolucionando. En los últimos años, sobre todo, las sucesivas sentencias del TC, y también del TS, así como leyes recientes, interpretan la función social de forma amplia, más amplia, de manera que su paulatino crecimiento, tiene como contrapartida la disminución del contenido típico y tradicional del derecho de propiedad, que ve mermadas las facultades de las que se compone. En este trabajo, analizamos críticamente esta evolución.The right of property over real estate is a constitutionally protected subjective right that has changed considerably from its origin to the present day.
